AI-Powered Productivity: Building a Better Tomorrow
This Affiliate Program Agreement (the "Agreement") is entered into by and between AI-Powered Productivity: Building a Better Tomorrow (the "Company") and the individual or entity applying to participate in the Affiliate Program (the "Affiliate"). By signing up for the Affiliate Program, the Affiliate agrees to be bound by the terms and conditions contained in this Agreement.
To begin the enrollment process, the Affiliate must complete the affiliate application. The Company reserves the right to reject any application for any reason, including but not limited to, websites or marketing methods that promote illegal activities, violence, discrimination, or any content deemed inappropriate by the Company.
2.1. The Affiliate shall promote the Company’s AI Productivity System courses and products using the unique affiliate link provided by the Company.
2.2. The Affiliate agrees to conduct all marketing activities in a professional and lawful manner.
2.3. The Affiliate must comply with all applicable laws, including Federal Trade Commission (FTC) guidelines regarding endorsements and testimonials. The Affiliate must provide clear, conspicuous, and FTC-compliant disclosures of the Affiliate’s relationship with the Company anywhere an affiliate link, promotional content, or endorsement is posted (including, without limitation, websites, landing pages, blogs, emails, and social media posts), in a manner that is easy to notice and understand (e.g., “I may earn a commission if you buy through my link.”).
2.4. The Affiliate shall not engage in "spamming" or any form of unsolicited commercial email.
2.5. The Affiliate shall not use the Company’s intellectual property, including logos and trademarks, in any way that suggests a partnership beyond the affiliate relationship without prior written consent.
3.1. Commission Rate: The Company agrees to pay the Affiliate a commission of 25% of the net sale price for each successful referral. A "successful referral" is defined as a purchase made by a customer who reaches the Company’s website via the Affiliate’s unique link and completes a transaction that is not refunded or disputed.
3.2. Tracking: The Company uses cookies to track referrals. Commissions are only earned if the customer completes the purchase within the specified cookie duration period.
3.3. Payment Schedule: Commissions are calculated at the end of each month. Due to the Company's 14-Day Action-Based Guarantee, commissions will be held for fourteen (30) days from the date of sale (the “Hold Period”) to ensure the sale is final and no refund has been requested. Commissions are payable only after the Hold Period has elapsed and only for sales that are not refunded, charged back, or otherwise reversed.
3.4. Refunds and Chargebacks: If a customer requests a refund under the 14-Day Action-Based Guarantee or initiates a chargeback, any commission earned on that sale will be deducted from the Affiliate’s balance.
The Affiliate is prohibited from:
5.1. Either party may terminate this Agreement at any time, with or without cause, by giving the other party written notice.
5.2. Upon termination, the Affiliate must immediately cease using all affiliate links and Company branding.
5.3. The Company reserves the right to terminate the Affiliate’s participation immediately and forfeit any unpaid commissions if the Affiliate breaches any terms of this Agreement.
The Company will not be liable for indirect, special, or consequential damages arising in connection with this Agreement or the Affiliate Program, even if the Company has been advised of the possibility of such damages.
The Affiliate agrees to indemnify and hold harmless the Company and its employees, directors, and agents from any claims, damages, or expenses arising out of the Affiliate’s marketing activities or breach of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
The Company reserves the right to modify any of the terms and conditions in this Agreement at any time. Continued participation in the Affiliate Program following the posting of a change notice or new agreement constitutes binding acceptance of the change.
